Doctors are only human and therefore make mistakes, unfortunately often at the expense of the patient. If you suspect that the therapeutic failure was caused by a doctor's mistake, you can defend yourself.
This is how you can proceed if you suspect that a doctor has acted negligently.
Firstly, speak directly to the doctor concerned. Be open and tell them your concerns without being abusive. Many things can be clarified in this way. However, the doctor naturally wants to protect himself and may twist the truth, knowing that you as a layperson are easily fobbed off.
If the conversation with the doctor cannot dispel your suspicions, first collect all the data relating to the case. Make a note of medical examinations, treatments and conversations as truthfully as possible.
You can have the patient file copied for a fee of around 50 cents per page.
Talk to your health insurance company about your suspicions. If the suspicion of medical error seems justified, the health insurance company can commission an expert opinion.
Contact the consumer centres and patient associations.
If the incident occurred in a hospital, you can contact the hospital management directly.
The regional medical associations offer a free procedure, provided that the other party agrees to this.
Whether you have legal expenses insurance or not, you can of course go to court as a last resort, but this can be costly. Hire a specialised lawyer. You can obtain contact details for lawyers from the Bar Association.
You have the burden of proof. So collect as much evidence as possible for your case.
